DISCLAIMERS, WAIVERS AND INDEMNITY:
Buyer's purchasing or placing a bid on Item (Item includes the product in this listing, plus any accessories or ancillary products purchased from this Seller), regardless in which venue or location the sale is consummated, constitutes the following:
* Buyer accepts Item in its current as/is condition.
* Buyer hereby agrees that they have read and agree to be bound by all Terms and Conditions within this listing and this section.
* Buyer has had the opportunity to contact Seller to ask any questions regarding this Item prior to purchase.
* Buyer acknowledges we are neither the manufacturer of this Item nor an agent of the manufacturer.
* Buyer waives all liability of Seller and claims against Seller for damages, losses, costs, injuries, penalties, expenses, attorney's fees and liabilities of whatever nature whether in tort, contract, warranty or strict liability, including without limitation those resulting from injuries or deaths of persons and damages to property resulting from, or arising out of or in connection with the use, condition, transportation, service, possession, rental or sale of this Item, loss or liability resulting from negligence, breach of warranty, parts, labor, delay or business interruption by Buyer or third parties, delivery delays, work stoppages, failure to warn, operational deficiencies or failures, breakdowns, strikes, acts of God, or other cause (whether such causes are avoidable or not) caused in whole or in part, directly or indirectly by Buyer, Seller’s employees, representatives, agents or third parties (collectively, "specified claims").
* Under no circumstances is Seller responsible for special, indirect, incidental or consequential damages, even if Buyer has been advised of their possible existence.
* Buyer agrees to indemnify, defend and hold Seller harmless from and against any and all specified claims.
* Seller hereby disclaims all warranties, express and implied, with respect to this Item, including without limitation, any implied warranties of merchantability, fitness for a particular purpose, or that the Item is free from latent defects.
* Seller reserves the right to refuse sale to anyone not in compliance with eBay's rules or our Terms and Conditions. All Items are 100% brand new, and not refurbished in any way, unless the listing specifically states otherwise.
All Items will arrive in working condition.
"Defective on Arrival" claims must be made within 3 days of you receiving the Item. Seller will choose to either send replacement parts, issue buyer a refund or exchange the item in question.

Returns
• No Return, Refund nor Exchange for RC Cars, Boats, Plane, Tank, Train and Local Motive, or any Moving, motion, power absorbing, power generation devices.
• All returns must be pre-authorized by seller and are subject to a 25 % restocking fee
• All returns must be shipped (postmarked) to Seller within 14 days of the date your order(s) shipped. Please refer to the order status for confirmation of shipped date.
• All returned merchandise must be in NEW and UNUSED condition, and in the manufacturer's original package or box. Returned items must be in original packaging. Packages and boxes returned to Seller not meeting the above described criteria will be refused.
• All manufacturer printed materials originally sent with your purchased item must accompany the returned merchandise.
• All returned merchandise must be shipped with the Seller issued Return Authorization (RA) number clearly marked on the exterior of shipping carton / envelope.
• Closeout, Blowout and/or Special Order items will not be accepted for exchange or return.
• Shipping fees on returned merchandise are responsibility of the customer.
• Original shipping costs are not refundable.
• Items returned shipped "Freight Collect" will be refused.
• Exchanges are subject to product availability.
• Please follow the above mentioned criteria as returns received not meeting the criteria above will be ineligible for credit or exchange and will be returned to the sender.
• International Returns - All International returns must adhere to all the conditions mentioned above. In addition, the sender is the exporter of record and is solely responsible for all shipping costs and applicable duties and taxes. All non-compliant shipments will be refused by Seller. Refunds will be processed in U.S. dollars. Product exchanges processed and shipped to International customers will be assessed shipping charges in accordance to Seller’s International Shipping policy unless the exchange is a result of a Seller error. The recipient of the shipped exchange product is the importer of record and is responsible for all duties and taxes.
